1. Acceptance of Terms

By accessing or using OUTRUN ("the Application," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.

These Terms constitute a legally binding agreement between you and OUTRUN. We may modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Eligibility and Age Requirements

2.1 Age Requirements

  • You must be at least 13 years old to use the Application
  • Users in the European Economic Area (EEA) must be at least 16 years old
  • Users under 18 require parental or guardian consent

2.2 Account Responsibility

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must immediately notify us of any unauthorized use of your account
  • You must provide accurate and complete information when creating an account

2.3 Prohibited Users

You may not use the Application if:

  • You are under the minimum age requirement
  • You have been previously banned from the Service
  • You are located in a jurisdiction where the Service is prohibited
  • You cannot form a legally binding contract

3. Description of Service

OUTRUN is a health and fitness application that enables:

  • Lactate monitoring during training (manual entry with smart predictions)
  • Training session management (solo, team, or remote coaching)
  • Predictive lactate values based on heart rate, pace, and previous readings (algorithm-based estimates)
  • Data visualization and analytics
  • Training journal entries with RPE (Rate of Perceived Exertion) tracking
  • Integration with third-party health platforms (Garmin - planned, not yet implemented)
  • Coach-athlete collaboration features
  • Real-time session monitoring (planned feature, not yet available)

The Application is for informational and training purposes only and is not a medical device.

4. User Accounts

4.1 Account Creation

  • You must provide accurate, current, and complete information
  • You must choose a secure password
  • You may not use another person's information without authorization
  • You may not create multiple accounts to circumvent restrictions

4.2 Account Security

  • You are responsible for maintaining account security
  • You must not share your account credentials
  • You must log out after each session on shared devices
  • We are not liable for losses due to unauthorized account access

4.3 Account Termination

  • You may delete your account at any time
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your right to use the Service immediately ceases
  • Data deletion follows our Privacy Policy (30-day retention period)

5. Acceptable Use

5.1 Permitted Uses

You may use the Application to:

  • Track your own training and health data
  • Participate in training sessions
  • Share data with authorized coaches
  • Export your data for personal use

5.2 Prohibited Uses

You may NOT:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful code, viruses, or malware
  • Attempt to gain unauthorized access to systems or data
  • Interfere with or disrupt the Service
  • Create fake accounts or impersonate others
  • Harass, abuse, or harm other users
  • Use the Service for commercial purposes without authorization
  • Reverse engineer, decompile, or hack the Application
  • Scrape or harvest user data
  • Circumvent security measures or authentication

6. Health and Fitness Data

6.1 Not Medical Advice

  • The Application is NOT a medical device
  • Data is for informational and training purposes only
  • We do NOT provide medical advice, diagnosis, or treatment
  • Always consult healthcare professionals for medical decisions
  • Do not rely solely on the Application for health decisions

6.2 Data Accuracy

  • You are responsible for the accuracy of manually entered data
  • We strive for accurate data collection but cannot guarantee perfection
  • Sensor data (Garmin, etc.) is provided "as is" from third parties
  • We are not responsible for errors in third-party data
  • Predictive values are estimates based on algorithms and historical data, not medical diagnoses
  • Predictive values may not be accurate for all individuals or training conditions
  • Always verify predictions with actual measurements when possible

6.3 Health Risks

  • Discontinue use if you experience adverse effects
  • Consult a healthcare professional before starting new training programs
  • The Application does not replace professional medical supervision
  • Use the Application at your own risk

6.4 Predictive Features

  • Predictive lactate values are algorithm-based estimates, not medical diagnoses
  • Predictions are based on research-informed models but may not be accurate for all individuals
  • You should verify predictions with actual measurements when possible
  • We do not guarantee prediction accuracy
  • Predictions improve over time as more data is collected, but individual accuracy varies
  • You are responsible for making training decisions based on predictions
  • We are not liable for decisions made based on predictive values

7. Intellectual Property

7.1 Our Rights

  • The Application and all content are owned by OUTRUN or our licensors
  • All trademarks, logos, and service marks are our property
  • You may not copy, modify, distribute, or create derivative works without permission

7.2 Your Content

  • You retain ownership of user-generated content you submit
  • You grant us a limited, worldwide, non-exclusive license to use your content to:
    • Provide and operate the Service
    • Improve and develop the Service
    • Display your content within the Application
  • You represent that you have the right to grant this license

7.3 Third-Party Content

  • The Application may contain third-party content
  • Third-party content is subject to their respective terms
  • We are not responsible for third-party content

8. Third-Party Services

8.1 Integrations

  • The Application may integrate with third-party services (Garmin, Apple HealthKit, etc.)
  • Third-party services have their own terms and privacy policies
  • You are responsible for reviewing and accepting third-party terms
  • We are not responsible for third-party services

8.2 API Usage

  • You must comply with third-party API terms of service
  • You must not abuse or exceed API rate limits
  • We may suspend access if you violate third-party terms

9. Payment and Subscriptions

9.1 Free Service

  • The Application is currently provided free of charge
  • We reserve the right to introduce paid features in the future
  • Any future pricing will be clearly communicated

9.2 Future Paid Features (if applicable)

  • Subscription fees will be clearly displayed
  • Payments are processed by third-party payment processors
  • Refunds are subject to our refund policy (to be defined)
  • We reserve the right to change pricing with notice

10. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Application, you consent to the collection and use of information as described in the Privacy Policy.

11. Disclaimers

11.1 Service Availability

  • The Service is provided "as is" and "as available"
  • We do not guarantee uninterrupted or error-free service
  • We may modify, suspend, or discontinue the Service at any time
  • We are not liable for service interruptions or downtime

11.2 Data Loss

  • We are not responsible for data loss
  • You are responsible for backing up important data
  • We recommend exporting your data regularly

11.3 Third-Party Content

  • We are not responsible for third-party content or services
  • Links to third-party websites are provided for convenience only
  • We do not endorse or assume responsibility for third-party content

12. Limitation of Liability

12.1 To the Maximum Extent Permitted by Law

We are NOT liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Personal injury or property damage
  • Errors or inaccuracies in data
  • Service interruptions or failures
  • Third-party actions or content

Our total liability shall not exceed the amount you paid us in the past 12 months (or $0 if the Service is free).

12.2 Mandatory Consumer Protection Laws

  • This limitation does not affect your rights under mandatory consumer protection laws
  • In jurisdictions where limitations are not permitted, our liability is limited to the maximum extent allowed by law

12.3 Medical Disclaimer

  • We are NOT liable for any health decisions made based on Application data
  • We are NOT liable for injuries or health issues arising from training
  • Always consult healthcare professionals for medical decisions

13. Indemnification

You agree to indemnify, defend, and hold harmless OUTRUN, its operators, and affiliates from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws

14. Termination

14.1 By You

  • You may terminate your account at any time
  • Account deletion follows our Privacy Policy (30-day retention)

14.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • You abuse the Service or other users
  • Required by law or legal process
  • We discontinue the Service

14.3 Effect of Termination

  • Your right to use the Service immediately ceases
  • We may delete your account and data (subject to Privacy Policy)
  • Provisions that by their nature should survive will survive termination

15. Dispute Resolution

15.1 Governing Law

  • These Terms are governed by the laws of Norway
  • Any disputes will be subject to Norwegian jurisdiction

15.2 Informal Resolution

  • We encourage informal resolution of disputes

15.3 Arbitration (if applicable)

  • Disputes may be resolved through binding arbitration
  • Arbitration will be conducted in Norway under Norwegian law

16. Changes to Terms

  • Material changes will be communicated via email or in-app notification
  • Continued use after changes constitutes acceptance

16.2 Your Rights

  • If you disagree with changes, you may terminate your account
  • Previous versions are archived and available upon request

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Code of Conduct, constitute the entire agreement between you and OUTRUN regarding the Service and supersede all prior agreements.

19. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

  • You are of legal age to form a binding contract (or have parental consent)
  • You will comply with all applicable laws and regulations
